1. Agreement
By accessing or using The Court Scout (the "Site"), you agree to these Terms of Service. If you do not agree, do not use the Site. The Site is operated by The Court Scout ("we", "us", "our").
2. What we publish
The Site is an informational directory of racquet-sport courts. We research each listing against primary sources and label its verification status and last-checked date. Even so, court counts, hours, pricing, surfaces and operating status can change at any time without notice. The Site is provided for informational purposes only; we do not guarantee that any listing is current, complete, or error-free. Always confirm critical details (hours, fees, court availability) with the venue before you travel.
3. Acceptable use
You agree not to: (a) bulk-scrape, mirror, frame or republish the Site or its underlying data; (b) use automated systems that place an unreasonable load on the Site; (c) attempt to gain unauthorized access to the Site or its infrastructure; (d) use the Site or its data to harass venues or individuals; or (e) misrepresent the source of any data you take from the Site. We may rate-limit, block or terminate access for any user who violates these terms.
4. Submissions
When you submit a correction, addition, or other content (a "Submission"), you grant us a perpetual, royalty-free, worldwide license to use, edit and publish that Submission as part of the directory. You represent that you have the right to submit it and that it does not infringe anyone else's rights. We are under no obligation to publish a Submission and may edit it for accuracy, clarity or length.
5. Third-party content
Some venue ratings shown on the Site are provided by the Google Places API and are clearly attributed to Google. Those ratings are the property of their respective rights-holders and remain subject to Google's own terms. Outbound links (e.g. driving directions, venue websites) are provided for convenience; we are not responsible for the content of any third-party site.
6. Intellectual property
The Site's name, logo, layout, copy, code and curated dataset are owned by The Court Scout. You may link to individual pages and quote short excerpts with attribution. You may not copy the underlying dataset or substantial portions of the Site without our prior written permission.
7. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COURT SCOUT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING (WITHOUT LIMITATION) LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify and hold harmless The Court Scout and its officers, employees and agents from any claim, loss or expense (including reasonable attorneys' fees) arising out of your use of the Site, your Submissions, or your violation of these Terms.
10. Changes
We may revise these Terms from time to time. The "last updated" date at the top reflects the current version. Material changes take effect when posted; continued use of the Site after that date constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction.
